홍콩 보안법의 주요 내용은 다음과 같다.
- 국가를 분열시키거나, 전복하거나, 테러 활동을 하거나, 외국 세력과의 결탁할 시 최소 3년, 최대 무기징역의 처벌에 처할 수 있다.
- 홍콩 지방 정부나 중국 중앙 정부에 대한 혐오 조장은 29조에 따라 범죄 행위로 분류된다.
- 대중교통시설을 훼손하는 행위는 테러 활동으로 간주할 수 있다.
- 보안법을 위반한 이력이 있는 이는 앞으로 공직에 출마할 수 없다.
- 중국은 홍콩에 새로운 보안 부서를 설치하고 자체 인력을 편성한다. 보안 부서가 하는 업무는 홍콩 지방 관할권에 소속되지 않는다.
- 홍콩 행정장관은 보안법 관련 재판의 재판관을 직접 지명할 수 있다. 또 법무부 장관은 배심원 허용 여부를 결정할 수 있다.
- 홍콩 지방 당국이 세운 국가보안법위원회가 내린 결정에는 법적으로 이의를 제기할 수 없다.
- 중국은 "매우 심각한" 사건에 대해 기소권을 가질 수 있다. 일부 재판은 비공개로 치러질 수 있다.
- 외국 비정부기구와 언론사에 대한 관리가 강화된다.
- 38조에 따라 외국에 거주하는 비영주권자에게도 법이 적용될 수 있다.
- 법이 시행되기 이전의 행위에 대해서는 처벌하지 않는다
The main contents of the Hong Kong Security Law are as follows:
- Divide a nation, overthrow a country, engage in terrorist activities, or collude with foreign forces may result in punishment of at least three years, maximum life imprisonment.
- Disgusting the Hong Kong local government or the central government of China is classified as a criminal act under section 29.
- The act of damaging public transportation facilities can be regarded as an act of terrorism.
- Those who have a history of violating the security law cannot run for office in the future.
- China sets up a new security department in Hong Kong and organizes its own personnel. The work of the security department does not belong to Hong Kong's local jurisdiction.
- Hong Kong's administrative minister may directly appoint a judge in a trial related to security law. In addition, the Minister of Justice can decide whether to allow a jury.
- The decision made by the National Security Law Commission, established by the Hong Kong regional authorities, cannot be legally challenged.
- China may have the right to prosecute for "very serious" cases. Some trials can be held behind closed doors.
- The management of foreign NGOs and media companies will be strengthened.
- Article 38 may also apply to non-shareholdings residing in foreign countries.
- We do not punish acts before the law came into force.
